2. General conditions of use of the site and the services offered

Use of the website implies full acceptance of the general conditions of use described below. These conditions of use may be modified or completed at any time, and users of the website are therefore invited to consult them regularly.

The Tarbes Tourist Office endeavours to provide permanent access to the site, 24 hours a day, 7 days a week. However, access to the site may be suspended at any time and without prior notice, in particular due to breakdowns, failures or paralysis of the network, the system and/or the means of communication, as well as due to maintenance and correction operations made necessary by the updating and proper functioning of the site.
The user undertakes not to hinder access to the site and/or the proper functioning of the site in any way that could damage, intercept or interfere with all or part of the site.
The Tarbes Tourist Office cannot be held responsible for any direct or indirect damage due to an interruption, malfunction of any kind, suspension or stoppage of the site and/or the services, for any reason whatsoever, or for any direct or indirect damage resulting in any way from access to the site and/or the services.
The user of this site acknowledges that he/she has the necessary skills and means to access and use this site. The communication protocols used are those in use on the Internet.
The Tarbes Tourist Office cannot be held responsible for elements beyond its control and for any damage that may be suffered by the user’s technical environment and, in particular, his computers, software, network equipment and any other material used to access or use the site and/or the services. It is reminded that fraudulently accessing or remaining in a computer system, hindering or distorting the operation of such a system, or fraudulently introducing or modifying data in a computer system constitutes an offence punishable by law.
Access to the website is free of charge. The costs of access and use of the telecommunications network are to be borne by the customer, in accordance with the terms and conditions laid down by his access providers and telecommunications operators.

3. Description of the services provided

The purpose of the website is to promote and inform about Tarbes and its surroundings.

The Tarbes Tourist Office endeavours to provide information on the website that is as accurate as possible. However, it cannot be held responsible for any omissions, inaccuracies or shortcomings in the updating, whether these are its fault or that of third party partners who provide this information.

The information on the website is not exhaustive. It is given subject to modifications having been made since it was put on line.

4. Intellectual property and counterfeiting

The Tarbes Tourist Office is the owner of the intellectual property rights or holds the rights of use on all the elements accessible on the site, in particular the texts, images, graphics, logos, icons, sounds and software.

Any reproduction, representation, modification, publication, adaptation of all or part of the elements of the site, whatever the means or the process used, is forbidden, except with the prior written authorisation of the Tourist Office of Tarbes.

Any unauthorised use of the site or of any of the elements it contains will be considered as constituting an infringement and will be prosecuted in accordance with the provisions of articles L.335-2 et seq. of the Intellectual Property Code.

The reproduction, use and exploitation of photographs published on the website are prohibited without the prior agreement of their author.

6. Hypertext links

The website contains a certain number of hyperlinks to other sites which are not published by the Tarbes Tourist Office. The latter does not have the possibility of checking the content of the sites visited in this way, and consequently assumes no responsibility in this respect.

The creation of hypertext links to the home page of the website can only be set up with the agreement of the Tarbes Tourist Office.
– The use of a link can only be granted to sites related to tourism, activities related to tourism, search engines, as well as sites referring to Tarbes.
– Requests to link to our site should be made by e-mail to our webmaster.
– The sites using a link with our site must keep us informed of important developments and modifications of their content, and, if necessary, of the removal of this link.
– The Tarbes Tourist Office reserves the right to withdraw its authorisation for a link at any time, without having to specify the reason to the site concerned.
The URL of the targeted page must be clearly indicated. The user site must not make the site appear to be its own, distort the content of the target site, or clearly indicate that the user is being directed to
The pages of the site must not be embedded within the pages of another site, but must be displayed in a new window. No mirroring of the site, i.e. uploading to another URL, is permitted.

The Tourist Office of Tarbes may use as proof any act, programmes, data, files, recordings, operations and other elements (such as monitoring reports or other statements) of a nature or in a computerised or electronic format or medium, established, received or kept directly or indirectly by the Tourist Office of Tarbes, for example in any database.

Applicable law

The use of this site and the services is governed by French law, to the exclusion of any other legislation, regardless of the place of use.

Attribution of jurisdiction

In the event of a dispute, and if no amicable settlement is reached, the Tarbes Tourist Office and the user will refer to the competent courts, to which they expressly grant jurisdiction, including in the event of summary proceedings and multiple defendants.
